THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5903 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking a direction to the learned XXV Metropolitan Magistrate, Miyapur, Cyberabad to expedite the hearing of C.C.No.858 of 2015 in the interest of justice.

Heard and perused the material available on record. Admittedly, a private complaint was lodged by the petitioner/de facto complainant against the respondents 2 to 7/accused as long back as in 2012, and the same was referred under Section 156 (3) Cr.P.C. to Madhapur Police Station on receipt of which the police registered the same as Crime No.541 of 2012 for the offences punishable under Section 120-B, 419, 420, 448, 468 and 471 read with Section 34 IPC. However, after completion of investigation the police filed the charge sheet, which was taken on file as C.C.No.858 of 2015 for the alleged offences. It is evident from the record that Non-bailable warrant was pending against A-1 and summons was issued to other accused.

Having regard to the facts and circumstances of the case and in view of the fact that the crime was registered in the year 2012, this Court is of the view that ends of justice would be met if the learned Magistrate before whom the case is pending is directed to dispose of the case as expeditiously as possible. Therefore, the XXV Metropolitan Magistrate, Miyapur, Cyberabad, Ranga Reddy District is directed to make every endeavour to complete trail in C.C.No.

With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending shall stand closed.
