CVNR, J CC 1143/2016 ORDER:

This contempt case is filed alleging wilful disobedience of order dt.28.12.2015 in W.P. No.42082 of 2015 whereby this Court directed the respondent to forthwith take a decision on the petitioners' application for building permission and communicate the same to them within two months from the date of receipt of the order.

In the counter affidavit filed by the respondent he has inter alia averred that in compliance with the order of this Court, a communication was sent to the Collector, Ranga Reddy District on 18.02.2016 requesting him to furnish his opinion/remarks in the matter so as to clarify whether the subject lands in Sy. No.194/2 to 194/5 are patta lands or inam government lands. That on verification of the land records and the details from "Maa Bhoomi" official website of the Revenue Department, it was reported by the SDC LAO/DD SLR, Greater Hyderabad Municipal Corporation (GHMC) that the subject lands are recorded as Kharijkata (Sarkari) lands, that as the GHMC has no authority to grant building permission to such lands, it has rejected the application of the petitioners and the amount paid by the them towards fee/charges to the GHMC will be refunded.

CVNR, J CC 1143/2016 Smt. P. Bhavana Rao, learned counsel for the petitioners, has not disputed the aforementioned averments in the counter. As the respondent has duly complied with the order of this Court by passing an appropriate order on the application of the petitioners for building permission, the order passed in the writ petition stood complied with. Hence, the contempt case is dismissed.
