THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44936 OF 2016 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the respondents 2 and 3 in not registering the crime against the fourth respondent basing on the complaint of the petitioner, dated 17.10.2016 and not taking any action against the culprits as illegal and arbitrary, and consequently direct the respondents 2 and 3 to register and investigate the complaint of the petitioner.

Heard and perused the material.

Learned counsel for the petitioner submits that though the petitioner lodged a complaint against the fourth respondent, the respondents 2 and 3 are not registering the complaint and are not taking up the investigation. Hence, he prays this Court to direct the respondents 2 and 3 to register the complaint against the fourth respondent and to take up investigation. Learned Assistant Government Pleader for Home (Andhra Pradesh), on instructions, submits that on receipt of the complaint of the petitioner, being there is an element of civil dispute between the parties, the same is referred to Pre Litigation Counsel Forum, and that the same is numbered as PLCF P.No.379 of 2016 and that the authorities directed the parties to approach the competent Court for remedy.

Considering the facts and circumstances of the case, this Court is of the view that there is nothing to adjudicate in the matter. The petitioner is at liberty to seek appropriate remedy before the competent Court. The writ petition is accordingly disposed of.
