THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY Writ Petition No.3575 of 2015 ORDER:
This writ petition is filed seeking to issue a Writ of Mandamus declaring the action of the respondents herein in not handing over the charge so as to enable the petitioner herein to continue as the Sarpanch of Nagaram Gram Panchayat, Dharur Mandal, Ranga Reddy District as illegal, and arbitrary, and consequently direct the respondents to hand over the charge and continue the petitioner as Sarpanch of the Gram Panchayat.
Heard the learned counsel for the petitioner and learned Government Pleader for Panchayat Raj.
The petitioner was appointed as Sarpanch of Nagaram Gram Panchayat, Dharur Mandal, in the year 2013. On 23-07-2014 the officials of the Anti Corruption Bureau laid a trap and implicated the petitioner in Crime No.10/RCT-HR/2014, under the provisions of Prevention of Corruption Act, 1988. The respondents issued a show cause notice to the petitioner. Petitioner submitted her explanation, denying the charges. Subsequently, the District Collector, 2nd respondent herein issued proceedings dated 25-09-2014, suspending the petitioner from the post of Sarpanch.
The learned Government Pleader for Panchayat Raj has produced a copy of the proceedings in G.O.Rt.No.112, dated 21-02-2015, before this Court, wherein the period of suspension was extended till 15-04-2015.
In that view of the matter, the writ petition is closed, leaving it open
to the petitioner to challenge the said proceedings. The miscellaneous petition filed in this writ petition shall also stand disposed of. There shall be no order as to costs. ________________________ A. RAJASHEKER REDDY, J.
