This writ petition is filed challenging the action of respondents in insisting the petitioner to vacate from the land an extent of Ac.1-06 cents in sy.No.306 and an extent of Ac.295 cents in sy.No.305/B1 totalling Ac.4-01 cents of dry land situated in Kommuru revenue village of Nandaluru Mandal, YSR Kadapa District, which was acquired by his father under D.K.patta dated 28-12-1961, for converting it in to house sites without following due process of law.
Learned Assistant Government Pleader for Revenue produced written instructions stating that revenue authorities never interfered with the possession and enjoyment of subject lands though it is transpired as dotted land. The land in other survey number is proposed for issue of house sites to the eligible beneficiaries of the sub-merged villagers of Kommuru Village of Nandalur mandal.
In view of the same, the writ petition is disposed of directing the respondents not to interfere with the possession and enjoyment of the petitioner over the subject land without following due process of law. There shall be no order as to costs.
