Suggala Nagabhaskara Venkateshwara Rao, s/o. Pullaiah, Aged about 51 years, occu:Business, r/o. Door No.7-57/2, Vissannapeta town and Mandal, Krishna district.

...Petitioner

and The State of Andhra Pradesh, rep.by its Principal Secretary, Panchayath Raj and Rural Development Department, Secretariat Buildings, Amaravathi, Guntur District and others.

.....Respondents The Court made the following:

ORDER:

Petitioner claims that he is the owner of house bearing Door No.7-57/2, Vissannapeta town and mandal and the Gram Panchayat is attempting to change the name of 7th respondent in his place in the Gram Panchayat records. Material on record would disclose that petitioner herein filed O.S.No.168 of 2017, pending on the file of the Court of Senior Civil Judge at Nuzvid seeking declaration that sale deed dated 25.07.2017 executed by 1st defendant in the name of 3rd defendant therein is sham, collusive, void and unenforceable; that to direct the defendants 1 and 2 to execute a regular sale deed in terms of agreement of sale dated 19.03.1990. Petitioner now apprehends that Gram Panchayat is attempting to change the name of 7th respondent herein in the place of petitioner in Gram Panchayat records and the same is arbitrary and discriminatory.

2.

As fairly submitted by the learned counsel petitioner, so far no notice is issued on the alleged request made by the 7th respondent for change of name in Gram Panchayat records. Admittedly, as suit filed by petitioner is pending consideration of trial Court, nothing prevents the petitioner to seek appropriate relief in the pending suit.

3.

For the above stated reasons, Writ Petition is dismissed leaving it open to petitioner to work out his remedies as available in law. Pending miscellaneous petitions shall stand closed. ___________________________ JUSTICE P.NAVEEN RAO Date: 22.10.2018 kkm
