Respondents Counsel for the petitioner: Mrs.K.Sujatha Counsel for respondent Nos.1 to 4: Assistant Government Pleader for Panchayat Raj (TS) Counsel for respondent No.5: -- The Court made the following:

ORDER:

The petitioner, who is a Member of Mandal Parishad Territorial Constituency of Kanimetta Village, Kothakota Mandal, Mahaboobnagar District, filed this writ petition feeling aggrieved by the purported inaction of respondent No.2 in initiating action against respondent No.5 for the alleged misfeasance and malfeasance pointed out in the enquiry report No.GB/107/2015, dated 08.06.2015, submitted by respondent No.4.

In support of his plea, the petitioner has filed a copy of the purported report of respondent No.4 addressed to respondent No.3.

A perusal of the aforesaid report shows that the same is not authenticated and it is also not known whether respondent No.3 has forwarded the same to respondent No.2.

As the grievance of the petitioner is innocuous, respondent No.3 is directed to consider the issue in the light of the aforesaid report, if any, submitted by respondent No.4 and initiate appropriate action according to law, based on the contents of the said report against respondent No.5, within a period of one month from the date of receipt of a copy of this order. Respondent No.3 shall intimate the action taken by him to the petitioner immediately thereafter. Subject to the above directions, the Writ Petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P.No.51452 of 2015 filed by the petitioner for interim relief shall stand disposed of as infructuous.
