THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1099 OF 2015 ORDER:

The present criminal revision case is filed by the petitioners challenging the order, dated 30.04.2015, passed in Crl.M.P.No.332 of 2015 in D.V.C.No.11 of 2014, by the Court of the XIII Metropolitan Magistrate, Cyberabad at L.B.Nagar, whereby the trial Court directed the petitioner herein to pay interim maintenance of Rs.3,000/- to the respondent No.2 herein and Rs.1,500/- each to the respondents 3 and 4 herein, payable on or before 10th of every month. Heard.

Learned counsel for the petitioner submitted that the petitioner is working in a chicken shop on a monthly salary of Rs.5,500/- and he has no other source of income. He further submits that the petitioner has to look after his old aged parents, and as such, prays this Hon'ble Court to reduce the interim maintenance ordered by the Court below. Considering the facts and circumstances of the case, the criminal revision case is disposed of with the following directions. (i) The petitioner herein is directed to pay 50% of the monthly maintenance ordered by the Court below, i.e., the petitioner is directed to pay monthly maintenance of Rs.1,500/- (Rupees one thousand and five hundred only) to the respondent No.2 herein and Rs.

750/- (Rupees seven hundred and fifty only) to each of respondents 3 and 4 herein, payable on or before 10th of every month; (ii) The petitioner is also directed to pay the arrears of maintenance amount calculating at 50% of the maintenance amounts ordered by the Court below, within a period of one month from today; and (iii) The trial Court is directed to dispose of the D.V.C.No.11 of 2014 within a period of three months, preferably by the end of September, 2015.

With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed.
