HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.27878 of 2016 ORDER:

The learned counsel for the petitioners submits that some third parties have encroached and made constructions in Survey No.650/4 of Suryapet Village and Mandal, Nalgonda District, to an extent of Ac.1-03 guntas and 0.4 1⁄2 guntas in Sy.No.650/1 of Suryapet Village and Mandal and that the petitioners have made representation dated 17-06-2016 to the 4th respondent for providing protection to the land. Even according to the said representation, some third parties have made constructions in the subject land and Sy.No.650 is renumbered and registered.

The petitioners are seeking direction to the Tahsildar to act against some third parties and the counsel for the petitioners is unable to point out under which provision of law, the 4th respondent has to take action against some third parties. There appears to be some disputes between the petitioners and third parties. The petitioners have not even made the so-called encroachers as parties to the writ petition.

In view of the same, I do not see any reason to entertain the writ petition. However, it is open for the petitioners to avail alternative remedy available under law.

Accordingly, the writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
