HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 6 1 8 1 of 2 0 1 8 ORDER: - Heard learned Counsel for the petitioner, learned Government Pleader for respondents No.1 to 3 and Sri A.Rama Rao, learned Counsel appearing for unofficial respondents No.4 to 9.
The sum and substance of the grievance of the petitioner in the present Writ Petition is despite registration of Cr.No.203 of 2018 against the unofficial respondents on 05.07.2018, the unofficial respondents are repeatedly interfering with the activities of the petitioner herein and repeating the same offences. It is further alleged that the S.H.O., Salur, is not taking any action.
On the other hand, it is submitted by the learned Counsel for the unofficial respondents that the very Writ Petition is not maintainable and the petitioner has to avail the alternative remedy.
As per the instructions furnished by the Sub-Inspector of Police, Salur Town Police Station, Vizianagaram District, which are placed on record by the learned Government Pleader, the investigation in Cr.No.203/ 2018 is in progress and the report of the Tahasildar, Saluru Mandal, is awaited. It is further stated in the instructions that after receipt of the report from the authorities, the investigation will be finalized and necessary action will be taken against the accused. It is also stated in the written instructions that earlier, a case was registered in Cr.No.1
of 2018 for the offence under Section 107 Cr.P.C.,, with regard to the subject matter of the Writ Petition against the complainant and the accused parties on the file of Salur Town Police Station and the Mandal Executive Magistrate, Salur, bound over them vide M.C.No.1 of 2018.
Having regard to the above instructions and keeping in view of the submissions of the learned Counsel for the petitioner and the learned Counsel for the unofficial respondents and the learned Government Pleader, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the respondentpolice authorities to complete the investigation in Cr.No.203/ 2018, as expeditiously as possible, strictly in accordance with law.
