Heard Smt. K.V. Rajasree, learned counsel appearing for the petitioner, learned Government Pleader for Panchayat Raj, Sri MSR Chandra Murthy, learned special counsel for respondents 2 and 3 and Sri Cheemalapati Ravi, learned standing counsel for the 5th respondent.
2. The petitioner was appointed as Field Assistant at Kota Village, Y. Ramavaram (lower) Mandal, East Godavari District in the year 2013. While so, on certain allegations, the 3rd respondent by order dated 22.06.2015 terminated the services of the petitioner temporarily and called for the explanation. Hence, the petitioner filed the present writ petition seeking to set aside the impugned order.
3. Learned counsel appearing for the petitioner submits that the impugned order was passed without giving any opportunity of hearing to the petitioner and due to political reasons. However, the petitioner filed an appeal before the 4th respondent on 30.07.2015 and the same is pending.
4. Since the appeal filed by the petitioner is pending with the 4th respondentAppellate Authority, I am not inclined to go into the merits of the impugned order. In the circumstances, the 4th respondent-Appellate Authority-Commissioner of Rural Development is directed to dispose of the appeal dated 30.07.2015 filed by the petitioner, in accordance with law, within a period of eight (8) weeks.
5. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, in this writ petition, shall stand closed. No order as to costs. __________________ R. KANTHA RAO, J
