Naveen Rao) Heard Sri M.V.Hanumantha Rao, learned counsel for appellants in both the appeals, Sri V.V.Raghavan, learned counsel for respondents in C.C.C.A.No.3 of and Sri Preetam Chand Yadav, learned counsel for respondents in C.C.C.A.No.27 of 2015.

Learned counsel on both sides informed the Court that the inter-se dispute between the parties is resolved amicably outside the Court and no further orders are required to be passed in this appeal.

Recording the statement made by learned counsel for both sides that the matter is resolved, the City Civil Court Appeals are dismissed.

learned counsel prayed to order for refund of the Court fee by placing reliance on the judgment in High Court of Judicature at Madras rep, by its Registrar General Vs M.C.Subramaniam and Others1 learned counsel for appellant 1 2021 SCC Online SC 109

- 3 - submitted that even without referring the matter to Lok Adalath, the parties are entitled to refund of the court fee and in view of settlement of dispute between the parties, the Court fee paid by the appellant may be directed to be refunded. 5.

Since the dispute is resolved between the parties by payment of sum as per their understanding, in view of the judgment in M.C.Subramaniam and Others, the appellant is entitled to refund of Court fees and after obtaining necessary certificates the same shall be refunded. Pending miscellaneous petitions, if any, shall stand closed.
