THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.221 of 2016 ORDER:

1. This Criminal Revision Case is filed by the petitioners-Accused Nos.1, 3 to 7 aggrieved over the order dated 23.12.2015 passed in Crl.M.P.No.724 of 2015 in C.C.No.721 of 2008 by the I Additional Judicial Magistrate of First Class, Jagtial.

2. The petitioners-accused are facing trial before the learned Magistrate for the offence punishable under Sections 498-A, 406 IPC and Sections 3 & 4 of the Dowry Prohibition Act. As the petitioners failed to appear before the learned Magistrate, NBWs were issued against them on 28.6.2011. The petitioners filed the above Crl.M.P. seeking to recall NBWs issued against them.

The trial Court dismissed the above Crl.M.P. Aggrieved by the same, the petitionersaccused filed this revision.

3. Heard and perused the material available on record.

4. Considering the facts and circumstances of the case, the petitioners are directed to surrender before the learned Magistrate and move an application afresh to recall NBWs issued against them. On such application being filed, the learned Magistrate is directed to recall NBWs issued against the petitioners-A1, A3 to A7 on condition of each of them executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum each to the satisfaction of the learned Magistrate. The petitioners are further directed to appear before the learned Magistrate on all hearing dates.

5. Accordingly, the Criminal Revision Case is disposed of. Miscellaneous petitions pending, if any, shall stand closed.
