THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35880 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking a direction to the 2nd respondent to proceed with the investigation in Crime No.18 of 2014 and file charge sheet before the concerned Magistrate.

Heard and perused the material available on record. The grievance of the petitioners is that the marriage of their son was performed with the 3rd respondent on 22.08.2010 as per the Hindu rites and at the time of marriage, except some customary presentations, there was no exchange of any dowry. Later the 3rd respondent and her husband left to U.S.A. on 10.09.2010 and resided separately on account of their employment. The 3rd respondent, at the behest of her mother, harassed their son in body and mind and she is the puppet in the hands of her mother. The son of the petitioners endured the said mental torture meted out by the 3rd respondent with a fond hope that she would mend her ways, but day-by-day her harassment increased and made the life of their son miserable.

Later, the 3rd respondent deserted the son of the petitioners and started residing separately and thereafter, she came back to India and lodged a complaint before the 2nd respondent on 22.05.2014 and a case was registered by the 2nd respondent as Crime No.18 of 2014 for the offence under Sections 498-A, 506, 323 IPC and Sections 3 & 4 of the Dowry Prohibition Act.

Considering the grievance of the petitioners, the 2nd respondent is directed to complete the investigation in Crime No.18 of 2014, as expeditiously as possible. The 2nd respondent is further directed to file the charge sheet before the concerned Magistrate.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J Date: 25th October, 2016.
