THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.17599 OF 2015 ORDER:

Heard the learned counsel for the petitioner as well as the learned Assistant Solicitor General appearing for the first respondent.

The prayer sought for in the writ petition is as under: " to issue a writ order or direction more particularly one in the nature of writ of Mandamus declaring the impugned show cause notice in No. 52/ CC/ 30/ 2014-F.F. (HC), dated 11-03-2015 issued by the 1st respondent is arbitrary, illegal, capricious, high handed, violate of the fundamental rights guaranteed to me under Articles 14, 21 of the Constitution of India apart from being in violation of the principles of natural justice and fair play and consequently direct the respondents to drop the aforesaid proceedings or in the alternative to set aside the same" .

The first respondent filed a counter affidavit stating that after receipt of medical test report from the District Collector, Karimnagar District, the impugned show-cause notice has been withdrawn by the Ministry's letter No.52/ CC/ 30/ 2014-FF(HC), dated 26.06.2015. In the light of the said statement, no cause would survive for adjudication in the writ petition and accordingly, the writ petition is dismissed. No costs.
