THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No.7459 of 2015 ORDER:

This writ petition is filed seeking the following relief: "...to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the 3rd respondent on the petitioner's representation/application dated 11.10.2014 submitted for resumption of assigned land from 4th respondent as per the provisions of Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977 as illegal, irregular, irrational, amounts to non discharge of legal obligation conferred under the said statute and offends Articles 14 and 21 of the Constitution of India and consequently direct the 3rd respondent to initiate necessary action on his representation in accordance with law..." When the matter came up on 23.03.

2015, as the relief claimed in the main writ petition and the miscellaneous petition is one and the same, learned Government Pleader for Revenue was directed to obtain instructions. Learned Government Pleader, on instructions, submits that the land occupied by the 4th respondent is a water-body - Raavi Kunta, and necessary action would be taken by the authorities to evict the 4th respondent.

Recording the said submission, the writ petition is disposed of, directing the 3rd respondent to act on the representation of the petitioner and take action in accordance with law to restore the land in question, after issuing notice to the petitioner as well as the 4th respondent. The entire exercise shall be completed within a period of four (4) weeks from today. There shall be no order as to costs. The miscellaneous petitions filed in this writ petition shall also stand disposed of.
