Heard counsel for the petitioners, the Government Pleader for Services appearing for respondents 1 to 4, and Sri N.Praveen Kumar, Standing counsel for 5th respondent.

Petitioners contend that they have worked as NMRs in the 5th respondent Municipality, that the proposals have been sent by the 3rd respondent to the 1st respondent for regularization of their services as per G.O.Ms.No.212, Finance & Planning (PC.III) Department, dt.22.04.1994, and that the said proposals are pending with the 1st respondent and no orders have been passed thereon till date.

Petitioners also referred to G.O.Rt.No.566, Municipal Administration & Urban Development (D2) Department, dt.11.08.2016 issued by the 1st respondent constituting a Committee under the Chairmanship of the District Collector for scrutiny and for recommending the proposals for regularization of services in the Municipal Corporations in terms of G.O.Ms.No.212, dt.22.04.1994, and contend that the said G.O.Rt.No.566 dt.11.08.2016 has no application since the proposals in respect of the petitioners' regularization were sent much before the issuance of the said G.O..

The Government Pleader for Services appearing for respondents 1 to 4 states that the said G.O.Rt.No.566 dt.11.08.2016 would not apply to the case of the petitioners

since the proposals for their regularization have been forwarded by the 3rd respondent to the 1st respondent before the issuance of G.O.Rt.No.566, the said G.O. has no retrospective operation. He assures that the 1st respondent will consider the case of the petitioners for regularization within a period of eight (08) weeks from the date of receipt of a copy of this order, without reference to G.O.Rt.No.566, dt.11.08.2016, and communicate his decision thereon to the petitioners.

Therefore, the Writ Petition is disposed of directing the 1st respondent to consider the proposals sent by the 3rd respondent to it, in terms of G.O.Ms.No.212 Finance & Planning (PC.III) Department, dt.22.04.1994 within a period of eight (08) weeks from the date of receipt of a copy of this order, without reference to G.O.Rt.No.566, dt.11.08.2016, and communicate his decision thereon to the petitioners. There shall be no order as to costs. 6.

Consequently, miscellaneous petitions pending, if any, in this Revision shall stand closed.
