HON'BLE SRI JUSTICE T. AMARNATH GOUD CRIMINAL PETITION No.7017 of 2011 ORDER:

This criminal petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings against the petitioner in C.C.No.212 of 2010 on the file of the Principal Judicial First Class Magistrate, Miryalaguda, registered for the offences punishable under Sections 498-A IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961. The 2nd respondent is the de-facto complainant and the wife of the petitioner/accused.

Notice has been served upon respondent No.1. However, there is no representation.

Without going into the merits of the case, the criminal petition is disposed of, directing the prosecution to complete the investigation in the light of Section 41-A Cr.P.C., and file charge sheet. Till investigation is completed and charge sheet is filed, petitioner shall not be arrested. A reasonable opportunity shall be given to both parties during the course of investigation. The parties shall cooperate with the investigation.

As a sequel, miscellaneous petitions if any pending stand closed.
