THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.434 OF 2016 ORDER:

This Criminal Revision Case is filed by the accused challenging the order of the Special Judicial First Class Magistrate, Prohibition and Excise Court, Srikakulam dated 16.12.2015 whereby the learned Magistrate dismissed Crl.M.P.No.1478 of 2015 in D.V.C.No.25 of 2015 filed by the petitioners to discharge them the said case.

After arguing for some time, the learned counsel for the petitioners confined his argument to the extent of dispensing with the presence of the petitioners before the trial Court. Being the offence alleged against the petitioners under the provisions of Protection of Women from Domestic Violence Act, 2005, the question of their identity before the trial Court does not arise. In the circumstances, the presence of the petitioner Nos.2 to 8 before the trial Court is dispensed with except on the dates so specifically the trial Court insists for their appearance. The trial Court shall allow the first petitioner to represent the petitioners 2 to 8 herein during the trial. The trial Court is also directed to dispose of the DVC as expeditiously as possible. The Criminal Revision Case is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
