THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No.129 of 2015 JUDGMENT: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) Learned counsel for the appellants wants to withdraw the writ appeal.

The appeal is accordingly dismissed as withdrawn. Pending miscellaneous petitions, if any, shall also stand dismissed. There will be no order as to costs. We are surprised to see that the Registry is not careful while registering this appeal, as firstly the Government of Andhra Pradesh cannot be sui juris and secondly neither the State of Andhra Pradesh nor the Government of Andhra Pradesh was made a party before the Hon'ble Trial Judge. Therefore, this appeal itself is defective and should have been returned. The Registry must be very careful in future while registering the cases. _______________________ K.J.
