THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.10642 OF 2018 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A.2, for grant of bail in Crime No.69 of 2017 of Jubilee Hills Police Station, Hyderabad, registered for the offences punishable under Sections 406, 420, 468 and 471 read with Section 34 of I.P.C. 2.

Heard the learned counsel for the petitioner/A.2 and the learned Additional Public Prosecutor representing the respondentState and perused the record. 3.

The learned counsel for the petitioner/A.2 would submit that the petitioner is an innocent person and falsely implicated in this case. Some of the accused are granted anticipatory bail in the subject crime and also contended that there is no specific role assigned to the petitioner and ultimately, prayed to allow the petition. 4.

The learned Additional Public Prosecutor opposed the grant of bail to the petitioner/A.2 and contended that the petitioner/A.2 is also involved in other Crime Nos.49 and 137 of 2017 of Jubilee Hills Police Station, Hyderabad. Those crimes were also registered for similar offences and ultimately, prayed to dismiss the petition.

The material on record reveals that A.1-B.Laxmanrao contacted the de facto complainant to sell plot at Jubilee Hills stating that it belongs to his sister viz., Urmila. In that process, he along with other accused collected an amount of Rs.20,00,000/- in total. The specific allegation against the petitioner/A.2 is that she acted as Urmila, spoke to the de facto complainant and instructed to pay an amount of Rs.20,00,000/- to A.1 and other accused. As contended,

there are two other criminal cases registered and pending against her for commission of similar alleged offences. The investigation is in process. The gravity of the offence is high. Hence, it is not a fit case to release the petitioner/A.2 on anticipatory bail. 6.

In the result, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
