THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36321 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents in not constituting/appointing Board of Trustee and not appointing the petitioner as Chairman to the fourth respondent Institution as arbitrary, illegal and contrary to the provisions of the Andhra Pradesh Charitable, Hindu Religious Institutions and Endowments Act, 1997 and consequently to direct the second respondent to appoint the petitioner as a Chairman to the fourth respondent Institution on first rotation basis. Heard and perused the material.

Learned counsel for the petitioner submits that the petitioner made an application, dated 06.10.2016, to the second respondent to appoint him as a Chairman to the fourth respondent Institution, but the second respondent has not passed any order considering the representation of the petitioner. He further submits that the second respondent may appoint any other person as chairman of the fourth respondent Institution and as such, he seeks a direction to the second respondent to consider the representation of the petitioner and appoint him as chairman of the fourth respondent Institution. Considering the facts and circumstances of the case, the second respondent is directed to consider the representation of the petitioner before appointing any other person as Chairman of the fourth respondent Institution.

It is made clear that if there is any other procedure to appoint Chairman to the fourth respondent Institution, this Order will not stand in the way of appointment of Chairman to the fourth respondent Institution. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 26.10.
