When the present transfer CMP was listed on 12.04.2018, there was no representation for the petitioner. Therefore, Registry was directed to list the matter under the caption 'for dismissal'. Learned counsel for the respondent is present even today. He would submit that O.P.No.5 of 2015, the transfer of which is sought in the present petition, was dismissed for non-prosecution before the Court below. However, there is no representation for the petitioner, despite listing the matter under the caption 'for dismissal'. Hence, the transfer CMP is dismissed for non-prosecution. No order as to costs.
