HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.10620 of 2018 ORDER :

Heard before admission and before notice to the 2nd respondent/de facto complainant and perused the docket order of the learned Magistrate, dated 16.08.2018.

As one of the conditions in releasing on bond direction to deposit passport, no way onerous, much less for interference. So far as one to represent the three accused, for regular adjournments concerned, Rule 37 of the Criminal Rules of Practice enables the petitioner/A.2 to file such petition for granting such permission by the learned Magistrate, by virtue of this order, with necessary conditions.

So far as the submission of the petitioner/A.2 frequently to go abroad being employee in Infosys Software Company to attend the job concerned, whenever any specific requirement is there, liberty is left open to him to file application with transit permission to leave the country by taking back the passport and after purpose to re-deposit as contemplated under Section 6(2)(f) of the Indian Passport Act and the G.S.Rt.No.726 of 1993 and as per the expression in Abdul Gaffar Khan v. State of Telangana1.

With these observations, the criminal petition is disposed of. Miscellaneous petitions pending, if any, in the criminal petition shall stand closed.
