THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE S.RAVI KUMAR WRIT PETITION NO.39322 OF 2015 ORDER: {Per the Hon'ble Sri Justice Ramesh Ranganathan} The impugned order of assessment dated 30.03.2015 is subjected to challenge in this Writ Petition on the ground that it was not preceded by a show cause notice.
Sri M.Govind Reddy, learned Special Standing Counsel for Commercial Taxes, on instructions, would fairly submit that as the impugned order was not preceded by a show cause notice, it would suffice if this Court were to set aside the impugned order and permit the second respondent to pass an order afresh and in accordance with law.
Granting permission as sought for, the impugned order is set aside. The second respondent shall put the petitioner on notice giving them an opportunity of being heard and thereafter pass assessment order afresh and in accordance with law.
