HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.4610 of 2015
PC: (Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) None appears for the petitioners.
Heard Mr. B. Narayana Reddy, learned Assistant Solicitor General for respondent Nos. 1 and 2.
This writ petition challenges the provisions of Ordinance No.3 of 2015, promulgated on 12.1.2015, as illegal, arbitrary, unreasonable, unjust and unconstitutional.
The Ordinance was subsequently made an Act of Parliament, being, the Mines and Minerals (Development and Regulation) Amendment Act, 2015 (Act No. 10 of 2015).
In view thereof, we have disposed of several such writ petitions as rendered infructuous, with liberty to the petitioners therein, to challenge the provisions of the Act. Hence, we are constrained to dismiss this writ petition for non-prosecution. Order accordingly.
The dismissal of this writ petition, however, shall not preclude the petitioners from filing a writ petition challenging the provisions of the Act, as unconstitutional. Consequently, pending miscellaneous applications shall also stand closed. ____________________ DILIP B. BHOSALE, ACJ _________________ S.V. BHATT, J 24th June, 2015 Pnb
