HON'BLE SRI JUSTICE S.V.BHATT W.P.No.37308 OF 2012 ORDER:
The petitioners pray for Mandamus declaring action of respondent in detaining the petitioners in IV year 1st Semester, B.Tech (Civil) Course, as arbitrary, illegal and contrary to principles of natural justice.
The writ petition was filed on 03.12.2012. This Court having regard to the grievance canvassed in the writ petition granted the following interim order: "Notice Before Admission returnable in two (2) weeks. Learned counsel for the petitioners is also permitted to take out personal notice to the respondents and file proof of service. Post after two(2) weeks.
It is directed that in case, the petitioners or any of them have attendance of 65%, they shall be permitted to appear in the examination. The same shall however be subject to further orders. " Learned standing counsel submits that as the interim order is conditional and none of the petitioners could comply with the condition stipulated in the interim order, the petitioners were not permitted to write examination.
I am of the view that having regard to the interim order and also with the passage of time, the petitioners are not interested in working out the writ prayer. The writ petition is dismissed for default. No order as to costs. _____________ S.V.BHATT, J Date:18.02.2016 Stp
