THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY TR.CMP No.414 of 2013 ORDER:

This petition is filed under Section 24 of CPC to withdraw I.P. No.5 of 2010 from the file of III Additional District Judge, Kakinada and transfer the same to the IV Additional District Judge Court at Kakinada to be tried along with O.S.No.64 of 2010.

2. When the matter is taken up for hearing, learned counsel for petitioner seeks permission of this Court to withdraw the transfer C.M.P. with liberty to the petitioner to avail all the remedies available to him under law including filing of the similar type of petition before the appropriate Court.

3. Permission as sought for is accorded.

4. Accordingly, the Transfer Civil Miscellaneous Petition is dismissed as withdrawn with liberty as prayed for. No costs. Miscellaneous petitions, if any pending, in this petition shall stand closed. _____________________ T.SUNIL CHOWDARY, J.
