HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.28724 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction on the part of the 4th respondent in disposing of the review petition of the petitioner dated 06.08.2016, as illegal and arbitrary.
2. Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies (Telangana).
3. A perusal of the record reveals that the petitioner's father was appointed as Fair Price shop dealer in respect of Shop No.11 of Shapur Village, Ghanpur Mandal, Mahabubnagar District, long back. The father of the petitioner died on 09.02.2016. After the death of the petitioner's father, the petitioner submitted a representation to the 4th respondent on 02.03.2016 to appoint him as Fair Price shop dealer in respect of the Shop No.11 of Shapur Village, on compassionate grounds, in view of G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-1) Department, dated 28.02.2014. After following the due procedure, the 4th respondent issued the impugned Memo No.F/223/2016, dated 11.07.2016 rejecting the claim of the petitioner. Thereafter, the petitioner filed review petition before the 4th respondent on 06.08.2016 to reconsider his case in the light of G.O.Ms.No.4, dated 28.02.2014.
4. At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the 4th respondent to dispose of the review petition dated 06.08.2016 in accordance with law. Learned Government Pleader also consented for the same. 5 .
Having regard to the facts and circumstances and also the submissions made by both the counsel, the 4th respondent is hereby
directed to consider and dispose of the review petition of the petitioner dated 06.08.2016 in accordance with law, as expeditiously as possible, preferably within a period of one month from the date of receipt of a copy of this order.
6 . With the above direction, the writ petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
