The present appeal is filed assailing the order and decree, dated 08.08.2016, passed in HMOP.No.69 of 2015 on the file of the learned Senior Civil Judge, Nandigama, wherein the application filed by the husband under Section 13(1)(ia) of the Hindu Marriage Act seeking divorce was rejected.

Pending the present appeal, both the parties filed CMAMP.No.1947 of 2017 seeking permission of the Court to grant divorce, by recording the terms and conditions mentioned in the memorandum of compromise filed along with the said application. The affidavit filed in support of CMAMP.No.1947 of 2017 shows that an amount of Rs.14,00,000/ - (Rupees Fourteen lakhs only) was paid to the wife towards permanent alimony vide three demand drafts being Demand Draft bearing No.786987, dated 20.10.2017, for an amount of Rs.5,00,000/ - drawn on Andhra Bank, Demand Draft bearing No.971908, dated 19.10.2017, for an amount of Rs.5,00,000/ - drawn on State Bank of India and Demand Draft bearing No.005482, dated 20.10.2017, for an amount of Rs.4,00,000/ - drawn on ICICI Bank. The husband and the wife are
also present in the Court and were identified by their respective counsel.

When examined, the wife stated that she has settled the disputes with her husband and has no objection for granting divorce. She also stated that she will withdraw the criminal case pending vide C.C.No.701 of 2015 on the file of VI Additional Junior Civil Judge, Guntur.

In view of the compromise entered into between the parties, CMAMP.No.1947 of 2017 is allowed and consequently, the civil miscellaneous appeal is disposed of, in terms of the compromise, granting divorce.
