HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 6 3 5 2 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, III-Town P.S., Rajahmandravaram (U) District, East Godavari District, dated 31.10.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that the writ petitioner viz., Dudi Veeravenisbd a written complaint on 24.09.2018 to the Superintendent of Police, Rajamahendravaram, East Godavari District and the same was received in the Police Station, III-Town P.S., Rajamahendravaram, on 13.10.2018 through tappal and the same was registered as a case in Cr.No.382/ 2018 for the offences under Sections 447, 427 and 506 r/ w 34 I.P.C., by the Sub-Inspector of Police, III-Town P.S. and issued interfere.

During the course of investigation, Sub-Inspector of Police, III-Town P.S., examined the petitioner and recorded his statement. The Investigating Officer visited the scene of offence and drawn rough sketch. The Investigating Officer broke open the lock which was placed to the gate with the help of the police constable and deliver the possession of the 1st writ petitioner. The investigation in this case is pending and some more witnesses have to be examined.

It is submitted that the Sub-Inspector of Police, III-Town P.S., read the contents of the Writ Petition filed by the writ petitioners and deny the allegations in toto. The writ petitioners on one hand and the respondents 5 to 8 on the other hand having some financial disputes. The writ petitioners did not

approach before the Station House Officer, III-Town P.S., and made false allegation that no police officer is available to receive the complaint.

It is submitted that the writ petitioner suppressed the facts and filed the present Writ Petition to get a direction from the Hon'ble High Court to the police.

It is submitted that the writ petitioner did not approach the Hon'ble High Court with clean hands. Hence, the Writ Petition is devoid of merits and liable to be dismissed."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, III-Town P.S., Rajahmandravaram (U), East Godavari District, dated 31.10.2018, with a further direction to the respondent-police authorities to investigate into the crime and conclude the same strictly in accordance with law.
