THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8553 of 2015 ORDER:
This Criminal Petition is filed by the petitioners-Accused Nos.1 to 4 under Section 438 Cr.P.C. seeking to grant anticipatory bail to them in FIR No.40 of 2014, which is revised as Crime No.746 of 2014 on the file of the Chief Judicial Magistrate at Agra through Station House Officer, Hariparvath Police Station together with the local police of Banjara Hills Police Station, The petitioners are alleged to have committed the offence punishable under Sections 409, 418, 420, 506 and 120-B IPC. Learned Public Prosecutor submitted that no case is pending on the file of the Banjara Hills Police Station. From the material available on record, it is evident that the petitioners are apprehending arrest by the Hariparvath Police on the basis of NBWs issued by the Court at Agra.
As the crime is pending in Agra, the present petition is not maintainable before this Court. At this stage, the learned Counsel for the petitioners, while submitting that the petitioners are ready to approach the Court concerned for obtaining anticipatory bail, has sought indulgence of this Court to stay the operation of the NBWs through Banjara Hills P.S. In view of the above submission, the petitioners are directed to approach the Court concerned for anticipatory bail on or before 23rd September, 2015. Till then, the respondents-police are directed not to arrest the petitioners. If the petitioners fail to approach the Court concerned on or before 23.9.2015, the respondents-police are at liberty to proceed in accordance with law.
Accordingly, the Criminal Petition is disposed of.
