THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CONTEMPT CASE NO.1135 OF 2015

O R D E R

(per Hon'ble Sri Justice Sanjay Kumar) This contempt case was instituted alleging disobedience to the order dated 23.03.2015 passed by this Court in PIL No.56 of 2015. By the said order, this Court directed the Telangana State Pollution Control Board to look into the complaint made by the petitioner and on enquiry, if the complaint was found to be correct, take appropriate measures against the offending industrial units in accordance with the due procedure. The Member Secretary, Telangana State Pollution Control Board, filed counter-affidavit dated 21.09.2015, which was taken on record on 09.10.2015, setting out the various measures taken against the industrial units upon the complaint made by the petitioner and pursuant to the order passed in the Public Interest Litigation. Supporting material was also filed in proof of the steps taken by the Pollution Control Board to monitor the pollution caused by the industrial units and the necessary safe-guards to be taken by such units in respect thereof.

Though time was sought on 09.10.2015 for filing a reply, no reply affidavit has been filed till date and again a request is made for further time to file a reply.

In the light of the counter-affidavit averments detailing the steps taken by the Pollution Control Board pursuant to the order passed by this Court in PIL No.56 of 2015, no grounds are made out warranting exercise of contempt jurisdiction at this stage.
