HON'BLE SRI JUSTICE C.PRAVEEN KUMAR W.P. No. 36287 of 2018 ORDER:

The present writ petition came to be filed seeking the following relief:

" To declare the action of the respondents in not recognizing the petitioner as hereditary Muthawalli of Hazarat Bara Shaheed Dargah, Nellore, SPSR Nellore district, as illegal, irregular, arbitrary, unjustified, unconstitutional and unsustainable and direct the 2nd respondent to forthwith treat the petitioner as hereditary Muthawalli of the 3rd respondent Dargah with due recognition of his hereditary rights."

At the time when the matter is taken up for hearing, learned counsel for the petitioner would submit that the petitioner made a representation on 06.03.2018 seeking appointment as Muthawalli of Hazarat Bara Shaheed Dargah, Nellore, SPSR Nellore district under Section 63 of the A.P. Wakf Act, and the same may be directed to be disposed of by the authorities.

Learned Standing Counsel for the A.P. Wakf Board would submit that if the representation made by the petitioner is pending, the same will be considered by the respondents in accordance with law.

Recording the above, the writ petition is disposed of at the admission stage, directing the A.P. Wakf Board to deal with the representation of the petitioner dated 06.03.2018, seeking appointment as Muthawalli of Hazarat Bara Shaheed Dargah, Nellore, SPSR Nellore district, in accordance with law, and pass orders, as early as possible, preferably, within a period of three to six months from the date of receipt of a copy of this order. Consequently, Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed.
