HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 13331 of 2015 ORDER:

The writ petitioners are aggrieved of the action of the second respondent-appellate authority in not passing orders in the appeal or in the stay application filed by them against the orders of the third respondent, dated 09.03.2015.

2. The averments in the writ affidavit are to the effect that 3rd respondent- Tahsildar, Sidhout Mandal, Kadapa district passed orders dt. 9.3.2015 against the petitioners for resumption of the assigned lands on the ground that the petitioners violated the provisions of Sections 3(1) and 3(2) of the A.P. Assigned Lands (POT) Act, 1977. Challenging the same, the petitioners preferred an appeal before the 2nd respondent-Revenue Divisional Officer, Rajampet, Kadapa District. Along with the appeal, the petitioners also filed an interlocutory application seeking stay of the operation of the order dated 9.3.2015 of the third respondent. The petitioners' grievance is that the second respondent has neither disposed of the Stay application nor the appeal..

3. Heard the petitioners' counsel and the learned Government Pleader.

4. Considering the fact that the appeal as well as the Stay application are pending before the second respondent, this writ petition can be disposed of by directing the second respondent to dispose of the Stay application, or preferably the appeal itself, within a period of three months from today. Till such time the Stay Petition or the appeal, whichever is earlier, is disposed of, there shall be Stay of operation of the order dated 9.3.2015 of the third respondent.
