WRIT PETITION NO. 32526 OF 2016 O R D E R :

This writ petition is filed by the petitioner seeking writ of certiorari pertaining to Proceedings in Rc.No.G1/Nil/2015, dated Nil/12/2015 issued by the second respondent inclusive of the same and quash the same by declaring that the writ petitioner is entitled to receive compensation in respect of the schedule property in survey No.391/1 in an extent of Ac:3-00 cents situated at Sakunala village, Orvakal Mandal, Kurnool district with regard to acquisition of schedule property for construction of solar project and to pass such other suitable orders as this Court may deems fit and proper in the circumstances of the case.

2. The petitioner is aggrieved by the declaration of Proceedings in Rc.No.G1/Nil/2015, dated Nil/12/2015 issued by the second respondent, wherein the name of the petitioner does not find place, however, mentioned the names of respondents 5 and 6.

3. Heard the learned counsel for the petitioner and the learned Government Pleader for Land Acquisition [AP] takes notice on behalf of respondents.

4. Keeping in view, the averments made in the affidavit filed in support of the petition and submission of the counsel for the parties, justice would be met if the respondents are directed to consider the petition of the petitioner and take steps accordingly.

5. I hereby direct the respondents 2 and 3 to treat this writ petition as representation filed by the petitioner, decide the same and pass appropriate orders on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.

The orders passed on the representation shall be communicated to the petitioner within one week thereafter. Till the decision is taken by the respondents, the compensation amount shall not be disbursed in favour of respondents 5 and 6 or any other person.

6. If the petitioner is still aggrieved with the action or inaction of the respondents, liberty is granted to the petitioner to challenge the same before appropriate forum.

7. In view of the above direction, the writ petition is disposed of at the admission stage. No costs.

8. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
