Respondent/complainant COMMON ORDER Since the issue involved in all the criminal petitions is one and the same, these criminal petitions were heard together and are being disposed of by this common order.

These Criminal Petitions are filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') seeking to enlarge the petitioners on bail, who are arrayed as accused Nos.2, 3 and 4 in Crime No.355 of 2025 on the file of the Railway Police Station, Secunderabad, registered for the offence punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act').

The brief facts of the case revolve around seizure of 45.860 Kgs. of Ganja. In connection with the said seizure, the petitioners were arrested, and a case was registered against the accused for the abovementioned offence.

Heard Sri Chandrashekhar Yadav S, learned counsel for petitioners, and Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent-State. 4.

Learned counsel for the petitioners submitted that the petitioners are innocent and have been falsely implicated in the crime. He contended that the investigation was completed without following due process, causing prejudice to the petitioners. He further contended that there are no criminal histories of the petitioners and they are law abiding citizens. Therefore, prayed this Court to allow this criminal petition, granting the relief of bail to petitioners.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that petitioners were involved in illegal possession of ganja which is of commercial quantity. Hence, prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioners are in jail since 04.07.2025. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 15 witnesses have been examined. Considering the facts and circumstances of the case and the incarceration period of the petitioners, this Court deems it fit to grant bail to the petitioners, subject to the following conditions:

i.

The petitioners shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned Sessions Judge, Hyderabad District at Nampally.

ii.

The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioners shall abide by the conditions stipulated in Section 437(3)

of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall also stand closed.
