Pothula Rama Mohan v. The State Of Andhra Pradesh
THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.36066 OF 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The grievance of the petitioner is that though he has made an application for grant of No Objection Certificate to the District Collector, Chittoor District, the 2nd respondent, in terms of G.O.Ms.No.307, dated 06.06.2013, as early as on 29.01.2015, no orders are passed on it. The petitioner states that he is an Ex-serviceman and was assigned the subject land on 10.08.1998 and since ten years period has expired, the petitioner is entitled to alienate the said land and hence, seeks permission to alienate the same. Since the application of the petitioner is stated to be pending with the 2nd respondent from 29.01.2015, it is appropriate to direct the 2nd respondent to consider the said application, if not already considered, on the basis of record and pass appropriate orders in accordance with law, expeditiously, preferably within a period of four weeks from the date of receipt of a copy of this order. The Writ Petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
