HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.23876 OF 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus seeking to declare the action of the respondents 2 to 5 in issuing Provisional Registration Certificates dated 09.06.2016 vide EA 011600019899 and dated 10.05.2016 vide E.A.No.011600019353 for doing aqua culture/prawn culture in an extent of Ac.3.05 cents in RS No.406/4 and Ac.0.88 cents in R.S.No.421/1 of Shrungavruksham village, Palakoderu Mandal, West Godavari District, without enquiring into the matter even and in spite of representations dated 06.06.2016 and 13.06.2016 to the respondents 2 and 5 intimating that on enquiry the existing prawn tank had been demolished and also the factum of restoration of the same by the respondents No.6 to 9 is illegal and arbitrary as per the guidelines issued in G.O.Ms.No.7 dated 06.03.2013 and G.O.Ms.No.15 dated 26.05.2015 and consequently suspend the Provisional Registration Certificates dated 09.06.2016 and 10.05.2016.
Heard the learned counsel for the petitioners, learned Government Pleader for Fisheries, learned Government Pleader for Revenue and Sri K.V.L.Narasimha Rao, learned counsel appearing for the unofficial respondents.
The only request made by the learned counsel for the petitioners is to direct the respondents 3 and 4 to consider the representations of the petitioners dated 06.06.2015 and 13.06.2016.
In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case.
Having regard to the facts and circumstances of the case, the second and fourth respondents are hereby directed to consider and dispose of the representations of the petitioners dated 06.06.2015 and 13.06.2016 in accordance with law as early as possible, preferably, within a period of one month from the date of receipt of copy of this order.
With the above direction, the writ petition is disposed of. As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
