THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.36128 of 2015 ORDER:
The petitioner earlier approached this Court in W.P.No.25996 of 2014 seeking directions to respondent No.3 herein for hearing and disposal of the appeal filed by the petitioner against the resumption order of respondent No.4 and the same was disposed of on 19.9.2014 directing respondent No.3 herein to fix an early date of hearing of the appeal, hear the appeal and dispose of the same in accordance with law expeditiously, preferably, within a period of three months from the date of receipt of a copy of that order. Alleging that the said order is not complied with and at the same time, there is a threat of interference with the petitioner's possession, the present writ petition is filed.
2. Learned Government Pleader for Revenue (A.P.) appearing for respondent Nos.1 to 4, on instructions, submits that the date of hearing the appeal was fixed as 16.5.2015 but the appeal was adjourned to 27.06.2015 and again, to 25.7.2015 for want of report from Tahsildar, Guntur. Subsequently, the petitioner herein made a request for adjournment and accordingly, it was adjourned to 26.9.2015 and it is stated to be still pending.

Though the further date of hearing is not mentioned in the instructions, in view of the earlier directions referred to above, I deem it appropriate to direct respondent No.3 to fix a date of hearing the appeal, hear and decide the appeal after issuing notice to the petitioner within a period of four (4) weeks from the date of receipt of a copy of this order. Pending compliance of the order as above, status quo existing as on today with regard to the land claimed by the petitioner in an extent of Ac.2.74 cents in demarcation No.610/1 of Pedapalakaluru Village, Guntur Mandal and District be maintained.
4. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
