HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.5853 of 2018 ORDER:
Aggrieved by the dismissal of an application for appointment of an Advocate Commissioner, the plaintiff in a suit for a bare injunction has come up with the above revision.
2. Heard Mr. Yalla Bandi Ramatirtha, learned counsel for the petitioner.
3. The petitioner already got an opportunity, when the court below allowed her previous application in I.A.No.424 of 2016 for the appointment of an Advocate Commissioner. Unfortunately, there was no cooperation from the counsel on both sides. Therefore, the Advocate Commissioner returned the warrant, as he was unable to execute the same. After a lapse of time, the petitioner took out a fresh application for appointment of Advocate Commissioner. Therefore, the dismissal of the same is perfectly in order and I do not find any material irregularity in the order of the court below warranting interference.
Hence, the Civil Revision Petition is dismissed. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
