HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI CONTEMPT CASE No.2787 of 2018 ORDER:

When the matter is taken up for hearing, learned Standing counsel appearing for the respondents submits that the order dated 26.04.2018 in W.P.No.23580 of 2015 passed by his Court has been complied with vide proceedings dated 28.11.2018 and the respondents have paid all terminal benefits to the petitioner, to which he is entitled to.

Learned counsel for the petitioner has contended that other consequential benefits as per the Rules were not paid, as the respondents have treated the suspension period of the petitioner as out of employment and not treated the same as spent on duty. Therefore, the proceedings dated 28.11.2018 have not been passed in true compliance with the order passed by this Court on 26.04.2018.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that the respondents have issued proceedings on 28.11.2018 in compliance with the order passed by this Court. Therefore, the Contempt Case is closed. If the petitioner is aggrieved by the proceedings dated 28.11.2018, he is at liberty to challenge the same in an appropriate proceedings.
