THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.17557 of 2012 ORDER:

Heard the counsel for the petitioner and the counsel for the respondents. With the consent of both the parties, the writ petition is disposed of.

The present writ petition is filed seeking issuance of writ of Mandamus declaring the action of 4th respondent in not passing orders on application dated 03-04-2012 made by the petitioner as illegal and arbitrary.

Though various grounds raised in the petition, learned counsel for the petitioner restricts his prayer seeking a direction to the 4th respondent to pass orders on the application dated 03-04-2012 made by the petitioner for grant of pattadar passbook and title deed in respect of the land to an extent of Ac.22-03 1⁄2 guntas in Sy.Nos.348, 349, 371, 372, 396, 400, 403, 406 and 407 situated at Anantharam village, Bhongir Mandal, Nalgonda District by mutating her name in the revenue records.

No counter is filed on behalf of the respondents, but the learned Government Pleader relied upon a memo dated 17-03-2012 issued by Tahsildar, Bhongir, wherein it is mentioned as under: " In this regard, Sri Chinthala Venkateshwar Reddy S/o.Raja Narsimha Reddy vide reference 2nd cited submitted a petition duly requesting this office not to sanction succession in favour of Smt.Ch.Swarupa Reddy W/o.Late Venkata Krishna Reddy as the lands held by the deceased are the joint properties of his father Sri Chinthala Raja Narsimha Reddy and the deceased Sri Chinthala Venkata Krishna Reddy who is the own brother of his father. In view of the above, the petitioner Smt.Chintala Swarupa Reddy w/o.ate Venkata Krishna Reddy and the objection petitioner Sri Chinthala Venkateshwar Reddy S/o.Late Raja Narsimha Reddy are both advised to come

forward duly settling their family dispute so as to enable this office to initiate appropriate action in the grievance. Though the representation made by the petitioner does not reflect disputes with regard to the partition of the property, a reading of the memo dated 17-03-2012 indicates that there are some disputes between the family members. But, however, since the request of the petitioner is only for considering the representation dated 03-04-2012 made by her, the present writ petition is disposed of directing the Tahsildar, Bhongir-4th respondent, to pass orders on the representation dated 03-04-2012, in accordance with law, within (12) weeks from the date of receipt of the order after hearing the petitioner and the objector Chinthala Venkateshwara Reddy S/o.Late Raja Narasimha Reddy, if the same is still pending. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
