THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3548 OF 2016 ORDER:
This Criminal Petition is filed by the petitioners under Section 482 of Cr.P.C. seeking to quash the proceedings in DVC No.24 of 2015 pending on the file of Judicial First Class Magistrate at Miryalguda.
Even though the learned counsel for the petitioners raised some arguable points to interfere with the trial, this Court is of the view that it is always better if the trial is conducted and the points now raised by the petitioners are to be decided by the trial Court after appreciation of evidence. Now, the learned counsel for the petitioners confined his argument to the extent of dispensing with the presence of the petitioners before the trial Court. In the circumstances, the presence of the petitioners before the trial Court is dispensed with except on the dates so specifically the trial Court insists for their appearance. The petitioners are directed to be represented by a counsel on all hearing dates. The trial Court is directed to conclude the trial as expeditiously as possible and appreciate the grounds raised by the petitioners at the time of trial.
