HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.6003 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the inaction of the 3rd respondent in considering the application dated 15.12.2015 made by the petitioner for conversion of land covered by survey No.109/11 of Papampalli Revenue Village, Ananthapuram Mandal and District admeasuring Ac.0.16 cents out of Acs.5.00 cents, as illegal and arbitrary.

Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

The limited grievance of the petitioner in this writ petition is that the 3rd respondent is not considering the application made by the petitioner on 15.12.2015, for conversion of land. Learned AGP, on instructions received from the 3rd respondent, would submit that no such representation is received from the petitioner. She, however, submits that the subject land is not an agricultural land.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the petitioner to make a fresh application before the 3rd respondent seeking conversion of land along with documents showing that the subject land in an

agricultural land, within a period of two weeks from today, in which event, the same shall be dealt with in accordance with law, at the earliest.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
