THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.4218 OF 2002 O R D E R:

This writ petition is filed questioning the order dated 08.02.2002, passed by the 1st respondent in Application No.44 of 2001.

On 18.08.2010, this Court permitted the petitioner to take out personal notice to the 2nd respondent by registered post with acknowledgment due and file proof of service and in default, the writ petition stands dismissed as against the 2nd respondent without any further reference to the Court. As the petitioner failed to comply with the said order, the writ petition stood dismissed against the 2nd respondent. Since the petitioner did not file any application so far seeking restoration of the dismissal order dated 18.08.2010 against the contesting respondent, nothing survives in the writ petition.

Accordingly, the writ petition is dismissed as infructuous. No order as to costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
