HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.44 of 2016 ORDER:

This petition is filed to withdraw O.P.No.38 of 2015 from the file of Senior Civil Judge, Jangaon, Warangal District, and transfer the same to Family Court, L.B.Nagar, Ranga Reddy. 2.

Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 11.11.2007 at Hyderabad and during their wedlock a girl child was born in the year 2008. She stated that after birth of girl child, attitude of respondent is changed totally and respondent abandoned her to her fate and went away from marital home and started living at his native place at Vanaparty Village, Jangaon Mandal. She stated that respondent filed O.P.No.38 of 2015 under Section 9 of Hindu Marriage Act before Senior Civil Judge, Jangaon, Warangal District. She further stated that the child is now seven years old, studying in a private school at Medipally and that she is taking care of her education. She stated that her father is a retired Class-IV employee and it is difficult for her to attend the Court at Jangaon and that she has no relatives at Jangaon. For these reasons, she prayed for transfer of O.P.No.38 of 2015 from Senior Civil Judge, Jangaon to Family Court, L.B.Nagar, Hyderabad. 3.

Respondent did not file any counter disputing the affidavit averments of petitions.

Heard both sides.

Advocate for petitioner submitted that as wife is facing difficulty in attending the Court at Jangaon with small child, aged about seven years, by taking her convenience, her request for transfer of O.P.No.38 of 2015 from Jangaon to Ranga Reddy may be considered.

Advocate for respondent submitted that in case of transfer to Family Court, L.B.Nagar, presence of respondent for each and every adjournment may be dispensed with, as physical presence is necessary in Family Court.

Considering the submissions of both sides and considering the convenience of wife, O.P.No.38 of 2015 is withdrawn from Senior Civil Judge, Jangaon, Warangal District, and transferred to Family Court, L.B. Nagar, Ranga Reddy District, for disposal in accordance with law. Family Court, L.B. Nagar, Ranga Reddy District, shall dispense with the presence of respondent herein i.e., husband for each and every adjournment. However, he shall appear as and when his physical presence is felt necessary for any specific purpose. 8.

Transfer C.M.P. is ordered accordingly.
