THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION NO.23047 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India challenging the inaction of the 2nd respondent in disposing of the representation of the petitioners, dated 05-01-2016.

2. A perusal of the record reveals that the 2nd petitioner herein filed O.A.No.92 of 2014 on the file of the A.P. Co-Operative Tribunal, Vijayawada challenging the order, dated 07-10-2014 passed by the 5th respondent and the resolution, dated 25-09-2014 passed by the 2nd respondent and the same was allowed on 27-03-2015.

3. The contention of the learned counsel for the petitioners is that the 2nd petitioner filed a petition before the 2nd respondent requesting to issue a certificate under Section 70-A of the A.P. CoOperative Societies Act, 1964 so as to file E.P. before the Civil Court.

4. Learned Government Pleader submitted that the representation is pending before the 1st respondent.

5. Having regard to the facts and circumstances of the case, this Court is not inclined to express any opinion with regard to the merits of the main writ petition.

6. Therefore, the Writ Petition is disposed of directing the 1st respondent to dispose of the representation of the petitioner, dated 0501-2016 in accordance with law as expeditiously as possible preferably within a period of one month from the date of receipt of a copy of this order. No order as to costs. Miscellaneous petitions, if any pending, in this Writ Petition shall stand closed.
