No representation on behalf of the petitioners inspite of the matter being posted under the caption 'for dismissal'.
Heard learned Government Pleader for Revenue. The present Writ Petition came to be filed seeking to direct the respondents not to dispossess the petitioners from their peaceful possession over the lands admeasuring Acs.2.22 guntas and Acs. 2.38 guntas in Survey Nos. 27/5 and 27/40 respectively situated at Ali Nagar, H/o. Chetlapotharam Village, Jinnaram Mandal, Medak District, pending disposal of the case before the Revenue Divisional Officer, Medak District as illegal and arbitrary.
When the matter is taken up for hearing, learned Government Pleader for revenue submits that an appeal is filed by the petitioners under Section 4A of the A.P.Assigned Lands (Prohibition of Transfers) Act, 1977(for short, 'the Act of 1977'), which is still pending consideration. A perusal of the material on record discloses that earlier one of the petitioners filed W.P.Nos.3868 of 2006 and 8358 of 2006 before this Court, wherein this Court granted leave to file appeal under Section 4A of the Act of 1977 before the appellate forum, as prayed by the petitioners and the accordingly dismissed the writ petitions as withdrawn. Subsequently, the petitioners moved an application under Section 4A of the Act, which according to both the parties is still pending consideration.
Without going into merits of the case and having regard to the circumstances stated above, the Writ Petition is disposed of directing the Revenue Divisional Officer (2nd respondent) to dispose of the appeal filed by the petitioners, if any, within 12 weeks from the date of receipt of a copy of this order, if the same is still pending consideration. No costs.
