HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.1970 of 2015 ORDER:

This Contempt Case is filed alleging violation of orders passed by this Court in WPMP.No.29072 of 2014 in WP.No.23195 of 2014, dated 19-09-2014, wherein and whereby this Court directed to dispose of the representations of the petitioners dated 09-05-2014, 09-05-2014 and 12-05-2014 within a period of four (04) weeks.

Learned counsel for the petitioners made submissions reiterating the averments made in the affidavit and submits that order is not implemented and respondents have not considered the representations of the petitioners in proper perspective having called for valuation report from the Transport Department.

Learned Government Pleader for Forest submits that order has been complied with after considering the representations of the petitioners and order dated 22-10-2014 is passed. As such, there is no violation of orders passed by this Court.

In this case, only a direction was to dispose of the representation of the petitioners and respondents have passed orders in pursuance to the orders passed by this Court. Though the petitioners contend that the order is not correct, but the correctness or otherwise of the same cannot be decided in the contempt case.

In view of the same, since the order passed is in pursuance to the orders passed by this Court, I do not see any willful violation on the part of the respondents. Accordingly, the contempt case is disposed of granting liberty to the petitioners to challenge the order dated 22-10-2014 in accordance with law. As a sequel to the disposal of this case, miscellaneous applications, if any, pending shall stand closed.
